Conditions of Use of Steve’s Music Store Inc.’s (“Steve’s”) Website

Please read carefully:  By using Steve’s website (the “Website”), you acknowledge that you have read and agree to be bound by the conditions listed in this document that constitutes a contract between you and Steve’s. These conditions may be modified at any time by Steve’s without notice. Please make sure to consult this document every time you use our Website to take note of any changes that may have been made.

General Conditions:

    1. Steve’s operates its Website from Montreal, Province of Quebec, Canada. Steve’s makes no representation whatsoever to the effect that our Website can be accessed from outside Canada, if you are accessing our Website from another country or state, make sure that doing so does not violate any laws or regulations in force in the Province of Quebec, Canada or in your own jurisdiction. The User agrees to attorn to the jurisdiction of the courts in the district of Montreal, and to the application of the laws in force in  the Province of Quebec, Canada, with respect to choice of law.

    2. The prices on our Website may be different than Steve’s in-store prices. Steve’s reserves the right to change the prices on its Website without notice.

    3. Steve’s reserves the right to open the packages of the products it sells to inspect the merchandise or to adjust it if need be.

    4. Steve’s reserves the right to refuse any order.

    5. Any other use of any content of our Website — including reproduction for purposes other than those noted above, modification, distribution, or republication (including a website, online service, private or public intranet, and local or wide area network) — without the prior written permission Steve’s  is strictly prohibited. 

  1. Payment:

    1. Steve’s transactional Website will take the following modes of payment:

      1. Visa

      2. Mastercard

      3. Paypal

      4. Cash on delivery

      5. Cheque (Goods will be held until the cheque arrives and clears)

    2. The full payment will be taken immediately upon placement of the order.

    3. All merchandise will be delivered only upon reception by Steve’s of full payment including applicable taxes and delivery charges.

    9.    If Steve’s does not have stock on all or part of the order, Steve’s will deliver immediately what products it has in stock, and will deliver the balance of the order as soon as possible. If however Steve’s is unable to fulfill an order or part of an order, the order or any remaining unshipped order will be cancelled automatically after 60 days and Steve’s will credit you accordingly. (Unless previously contacted and advised via email on an updated estimated date of delivery.). Steve’s declines all and any responsibility for any back order or shortage of stock.

     Shipping and Delivery:

    1. All delivery charges and taxes will be added when applicable to the prices shown on our Website.  Duties and brokerage fees (if any) will be the sole responsibility of the customer, and may be collected by a third party.
      Please make sure you have entered the correct information for your coordinates and currency to get the correct pricing for your location.

    2. Steve’s ships via Purolator courier Ground Service or other major carriers. Delivery time (after notification) can take from 2 to 10 business days, to most major metropolitan areas. Rural area destinations may take a longer time, and/or require a depot pick-up. Any additional delivery charges as a result are the sole responsibility of the customer.

    3. Steve’s ships all items uninsured, and the risk of shipping loss or damage is the sole responsibility of the customer. For information purposes only, Purolator covers the first $100 value of goods. Additional insurance can be purchased for 3.25% of the remaining value (optional at time of check-out).

    4. Please note that all shipping quotes exclude the Northwest Territories, Yukon Territories, Newfoundland, Labrador, Nunavut and Rural Areas and may include items marked as Free Shipments). All orders placed from the listed areas in Canada will be reviewed by our shipping department and you will be advised of any additional shipping charges before we release the goods.

    5. Purchase amount is calculated before applicable Goods and Service Tax (GST) or Quebec Sales Tax (QST) and does not include shipping or insurance costs. Free shipping does not apply to "Beyond Point" areas; including, but not limited to, all of the Northern Territories (Nunavut, Yukon and Northwest Territories) Labrador, Newfoundland and any other areas dictated by Purolator Courier where extra shipping charges may apply. You will be notified of any additional costs before your order is processed.

    Warranties

    1. The warranties for the merchandise purchased are the sole responsibility of the manufacturers of such products.  Steve’s will act solely as an intermediary between you and the manufacturers whenever possible.

    2. All merchandise received by the customer must be inspected upon reception. The shipping company and Steve’s must be immediately notified of any damages.

    3. The customer should contact Steve’s in the case of malfunction of any merchandise received, and Steve’s personnel will guide you through the appropriate procedure.

    4. All shipping costs to and from the manufacturers or from Steve’s will be paid by the customer.

    Returns:

    1. Steve’s will only accept returns for credit with a return authorization number provided by our Website sales department, within the first 30 days of your purchase.

    2. The customer is responsible for freight charges (freight charges in both directions are applicable for free shipment items). Once a return authorization is given our shipping department will contact you to arrange for pick up. Steve’s will deduct these charges before any refund is processed.

    3. A 25% restocking fee may be deducted before we process any refund.

    4. Steve’s will only process a return item if it contains of all original packaging, including but not limited to: boxes, cases, manuals, cables, warranty cards, etc.

    5. All returns will be subject to inspection for abuse or wear in which event additional charges may be applied.

    6. Steve’s will not accept returns on consumable items, such as, without limitation, books, CD’s, DVD’s, software, harmonicas, reeds, strings (opened packaging), drumsticks, drum skins, clothing, stylus, media.

    7. Steve’s will not accept returns after 30 days.

    8. Refunds for payments made by credit card or cheque may take up to 10 business days to be processed after receipt and inspection of goods. Paypal payments refund may require up to 10 days.  There are no cash refunds, although a store credit or gift certificate good at any Steve’s locations may be requested at no additional charge.

    27.  Our Website and the products offered thereon are sold as is. Subject to provisions of any disposition of public order to the contrary, Steve’s shall not be liable for any damages and does not provide any other warranty than those specifically set forth herein. Steve’s makes no representation in relation with the use, download, effectiveness, exactness or reliability of the merchandise illustrated on our Website or in relation with the results pursuant to the use of the merchandise purchased from our Website. Steve’s does everything in its power to offer a Website free of errors, however Steve’s cannot be held liable for any error, including those relating to description, pricing or illustration. Steve’s, its affiliates, directors, officers, employees, representatives or agents shall not be liable for any direct or indirect damage arising from the use of the Website or the merchandise purchased thereon, including the loss of data or loss of profit or the inability of the client to us said merchandise.
